Although there are no open seats on the US Supreme Court, the Biden administration and top Democrats are anxious to place a new justice. Democrats are hopeful Justice Stephen Breyer, who is 82, will retire by early summer. Giving President Biden the opportunity to make good on his campaign promise to appoint the first Black woman Supreme Court justice.
Rep. James E. Clyburn of South Carolina has proposed District Court Judge J. Michelle Childs. Judge Childs’ appointment would also move away from justice’s historically Ivy League prerequisite. To reaffirm Democrats as the working-class party, top officials are pushing for candidates who attended public universities.
